Giving a tough fight to collection agencies

“Some debt collection agency in Georgia keeps calling me at the worst possible times…….early morning, dinner time or even in the Sunday mornings. They are looking for somebody named Jenny at my phone number. I do not have any idea who this Jenny is. They have the wrong number. I have told them multiple times that no one named Jenny stays here or used to stay here and guys you have the wrong number. But they won’t listen and keep calling me (obviously they think that I’m lying). How do I get them to stop calling me?”

As per the recent statistics, the number of complaints received by FTC in relation to collection agencies has increased to 69,204 in 2006, from 66,672 in 2005, a 3.8% increase. Although the Fair Debt Collection Practices Act is in place to regulate debt collection activities and behavior but most of the collection agencies DO NOT abide by those laws. They use unethical tactics to terrorize innocent consumers into paying debts that they do not even owe. Intimidation, using false pretenses and all kinds of manipulative means that are present under the sun are implemented by the debt collectors to ensure quick and efficient payments. And in most of the cases the collection agencies become successful because the consumers are unaware of the laws protecting them. Thus, it is a prerequisite for all the consumers to know what rights they are entitled to under the FDCPA.

Did you know that FDCPA prohibits a bill collector who works for a collection agency to call you before 8 am or after 9 pm? The law also bars them from
• calling you at work
• letting your employer and colleagues know about your debt, contacting your friends and family members and harassing them using abusive language, racial slurs or threats.
• making false representations or misleading statements or adding unauthorized charges then it

Under the FDCPA, you have the right to stop the collection agency from contacting you and intimidating you? Yes, the defense is cease and desist letter, send it via certified mail with a RRR. After receiving a cease and desist letter from you, the collection agency can contact you only once to notify you their actions: they will either tell you that they will stop making further attempts to contact you or that they are intending to take legal actions against you. However, if the CND does not work and you are still receiving annoying collection calls and harassing letter then you must file a complaint with FTC and BBB.
