1. Section 1: The first section of the agreement will have the simple information about the agreement like –
- The names of the persons/companies involved with the agreement.
- Location where the property is scheduled to develop.
- The date on which the agreement is signed with clear mentioning of the day, the month and the year.
- The date of commencement of the agreement.
- The name of the municipality that is in charge of overseeing the development.
2. Section 2: This section will define the terms used in the agreement. If the agreement is a simple home building contract, there will only be 2 to 3 definitions.
3. Section 3: The next section emphasize on the development plan which sketches out the project. It defines the ground rules of the project, the property limits and the ground rules of the project.
4. Section 4: This is the improvement section of the agreement. It is a long segment as it details all the improvements this development will do. Like improvements of sewage lines of the city.
5. Section 5: This section is called the ‘witnessed section’ of the agreement. It defines all the points that the real estate builder has to follow so that the development agreement is approved by the city. Before the agreement is approved, the city authorities will check whether your proposed development plot is zoned for the type of property the builder intend to do. They will also check the project development plan before granting approval.
6. Section 6: This is the final section of the agreement that lay emphasis on the parking rules, landscaping rules and some other rules for future construction on that plot. The deadline of the building project is also mentioned in this section.
Real estate development agreement helps to accomplish a development and in doing so, make administrative action unnecessary.
